I am saddened to say that many Texan breastfeeding mothers may be separated from their nursing infants immediately, if not already... While we may not agree or understand the circumstances, I think we need to fight for the right of the children to have the best care and nutrition, which includes breastmilk.

The issue is the safety of the infants. Whether to breastfeed should not even a consideration at this point. When the choice is breastfeeding in an unsafe house or placing an infant into a safe house and not breastfeed, is breastfeeding even something you want a Judge to consider. I hope not.

It depends, doesn't it, on what kind of harm is alleged? It is one thing to separate a breastfeeding infant from his mother when there is evidence that abuse or neglect of that infant has occurred or is likely to occur. It is another thing when the danger alleged is the abuse of girls in the community, which presumably won't be an issue for the infant until long after he or she is weaned. I don't know the facts of the case well enough to say.
In any case, the harm to an infant and to his mother when the breastfeeding relationship is disrupted is substantial and often permanent, so much so that yes, I do think it is something that a Judge should consider among other factors. Certainly at the stage when abuse is merely alleged, the state should have to show some likelihood of harm to the child if he remains with his mother, since harm will result from being separated from her.
